Important Things to Know

Establishing Compliance Outside of New Hampshire
Evergreen Tiny Homes, LLC provides services to clients across the country; however, the legal landscape surrounding tiny houses is subject to significant regional variation. Adherence to New Hampshire state codes does not ensure compliance in other areas. It remains the buyer’s exclusive duty to confirm all local ordinances at the project’s final destination prior to purchase.

Essential Regulatory Consultation
We urge all potential homeowners to engage with local building and planning departments before entering into contracts. Critical areas of inquiry should include:

  • Regional and municipal building standards

  • Zoning and lot-size restrictions

  • Setback and dwelling size minimums

  • Wheel-based versus permanent foundation rules

  • Technical classifications (ADU, RV, modular, or manufactured)

  • Grid integration (septic, water, and electrical permits)

  • Fire protection and safety protocols

  • Certification of Occupancy and inspection procedures

  • DMV registration and transit permits for trailers

Jurisdictional Authority and Placement

The ultimate authority on residential placement lies with local agencies. A unit designated as a primary residence in one county may be categorized as an RV or temporary shelter in another. Such distinctions govern the legality of your residence. Additional engineering or modifications may be required to align with local mandates.

Pre-Purchase Due Diligence
We advise clients to secure written validation from local regulators regarding:

  1. The legality of tiny homes (mobile or stationary) on the target parcel.

  2. Pertinent land-use districts and building codes.

  3. Requirements for utility hookups and associated permits.

  4. Rules governing the transportation and titling of the structure.

Statement of Buyer Obligation
Except where noted in a formal written agreement, the purchaser is responsible for all zoning clearances, utility setup, and government approvals. Evergreen Tiny Homes, LLC is tasked solely with manufacturing the unit to agreed-upon specifications. We offer no guarantee of occupancy approval across all diverse jurisdictions.

Notice for New Hampshire Residents
As of September 13, 2026, New Hampshire law identifies tiny houses and tiny houses on wheels (THOWs) as “innovative housing structures.” While this establishes a legal pathway at the state level, municipal zoning and land-use ordinances still apply. State statutes do not preempt local regulatory control.

Things We Are Currently Doing

Evergreen Tiny Homes is actively researching diverse financing solutions to help make the purchase of our trailers more accessible, including options structured as RV‑specific loan products. At this time, buyers may explore financing through personal loans or third‑party lenders such as LightStream, SoFi, etc. In addition, we are beginning to collaborate with municipalities within Strafford County—particularly their planning and zoning departments—to better understand when trailers may be classified as Accessory Dwelling Units (ADUs) versus when they are treated as recreational vehicles on private land.  Further updates will be disseminated as these regulatory frameworks continue to evolve.
